Del Ponte against Ramush Haradinaj’s defence in freedom

‘I am against his release due to his ability to interfere in preparation of the legal process and with the witnesses’, the paper quotes ICTY chief prosecutor, Carla del Ponte as saying at the OSCE Headquarters in Vienna, dailies write.

Ponte added that she has a bitter experience from the treatment of witnesses in Kosovo. She said that if the court decided in favour of his temporary release, the decision would be respected. However, she would file an appeal.

Del Ponte's position is fair, and it is to be expected. She holds a tough but fair line with regards to Serb indictees and the same is expected for other non-Serb indictees.

Nevertheless, the Tribunal itself will decide about this matter, not Del Ponte. For those of you that do not know this, there is difference between the Tribunal and Del Ponte. The Tribunal is the court which bring decisions, while Del Ponte is the procecutor. It must be said that Haradinaj's stand thus far deserves every praise.

Bearing in mind that the former Serbian president Milan Milutinovic has been released recently, it is fair to say that Haradinaj should be released as well.

As a procecutor I understand her position. Haradinaj is not Seselj, Milosevic, Karadjic, there is no danger if he is released.

There has already been witness intimidation in Kosova. Whats the point now?

It is curious that Del Ponte opposes so vehemently the release pending trial of someone who has the support of the vast majority of the members of the international community in Kosovo, people who know him and have seen the way he comports himself, to say nothing of the high regard in which his own people hold him. Is she disturbed by the intense interest taken by the international community in his treatement by the war crimes tribunal? Since when has it been considered appropriate that people defending their country against ethnic cleansing and genocide should be given less favourable treatment than the perpetrators? There surely cannot be much doubt about the suffering of Kosovars. Why is Del Ponte so assiduously opposing the release of Ramush Haradinaj when there are so many monsters stalking the Balkans completely unperturbed? Even judges who work under her remit are deeply critical of the way she behaves. Del Ponte gives the appearance of playing a tactical, politicized game. But the stakes are not hers to play with, they are the lives of other people. The court has transformed into a spectacle-largely, though not solely, through Del Ponte's doing. It is an experience we should learn from, try to remedy and ensure is not repeated in our future attempts to construct a just system of international law.

Ramush was once in Kosovo before one month. He returned back again in Hague. He is not one of those who will make any preasure upon the vitneses. I think that International Comunity is not fair. In Hague you have more Kosovar Albanians "responsible" for war crimes than you have Srbs for the war crimes that serbs did in Kosovo. It is very weel known who did what in Kosovo.
